The court of the swiss department of St. Gallen has stated that scientology is not a religion.

Background:

Elsbeth Bates had discussed scientology negatively in front of a school class. A scientologist filed a criminal complaint on the basis of §261 which deals with racism and related (e.g. anti-religous) hate. The prosecution declined to open a case. The scientologists tried to legally force the prosection to open the case - this failed.

The school board of Altstätten had now fobidden Elsbeth Bates to talk; people who takes sides in "difficult" topics shall no longer hold speeches at school.
